Child Support

Child support issues arise in the context of divorce, paternity proceedings and modifications after a divorce. In New York, the amount of child support a parent owes or can expect to receive is determined by statutory guidelines. The factors involved in the calculation include the amount of money each parent earns and how many children they have.

While courts do have discretion to lower the child support payment due to hardship, there must be compelling circumstances to justify such a downward adjustment. One such extraordinary cause includes serious medical concerns requiring the payment of unusual medical expenses.

Spousal Maintenance

Spousal maintenance, also known as spousal support and formerly known as alimony, can be awarded during the divorce process, either temporarily or permanently at the end of the divorce case. Like child support, New York has factors to determine the amount of spousal maintenance awarded while the divorce is in progress. However, the courts have greater discretion to determine how much to award in the final divorce judgment.

Modifications

Circumstances do change and sometimes when a parent loses a job or suffers serious medical problems, the parent can no longer afford to pay the same amount of child support that was previously awarded. In these cases, the parent can seek a child support modification. To justify a modification downward, there must be a substantial change in circumstances. If a parent’s income significantly increases, the other parent can seek an increase in child support, as well.
